RESOLUTION

COMMISSIONERS ORDER AMENDING

AND EXTENDING TILE PROJECT

IN THE MATTER OF THE

SINGLE COUNTY TILE #944

PETITIONED BY DANIEL ELLERBROCK

The Board of County Commissioners of Putnam County, Ohio, met in regular session on the 11th day of February, 2010, in the assembly room of the Putnam County Court House with the following members present: Mr. John E. Love, Mr. Vincent T. Schroeder and Mr. Travis A. Jerwers.

Mr. Jerwers moved the adoption of the following resolution:

WHEREAS, This being the day fixed by the Board in its order dated the 10th day of December, 2009, for the hearing on the petition in the above named improvement, the Board met in the assembly room and conducted the hearing by causing the petition to be publicly read.

and

WHEREAS, During the hearing landowners discussed amending and extending the petition filed by Daniel Ellerbrock.

now therefore, be it

RESOLVED, The Board of County Commissioners does hereby approve to amend and extend the terminus of the petition to accomplish the purposes of the improvement to include the repair and maintenance of the remainder of the John Weis Ditch and the John Diemer Ditch to the head end of a 12” tile on the West side of Road 7 in Section 1, Ottawa Township.

and be it further

RESOLVED, It is found and determined that all formal actions of this Board concerning and relating to the adoption of the Resolution were adopted in an open meeting of this Board, and that all deliberations of this Board and of any of its Committees that resulted in such formal action were in meetings open to the public in compliance with all legal requirements including Section 121.22 of the Ohio Revised Code.

Mr. Schroeder seconded the motion and the roll being called upon its adoption, the vote resulted as follows: Mr. Love yes Mr. Jerwers yes Mr. Schroeder yes
